Guardian Property Management LLC (hereinafter referred to as "GPM") provides the GPM Website www.guardianpropertymgt.com, (hereinafter referred to as the "GPM Site") subject to your compliance and agreement with this User Agreement, and our Privacy Policy below. PLEASE READ THIS BEFORE ACCESSING THE GPM SITE. BY ACCESSING THE GPM SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE GPM SITE.

Rules. While visiting the GPM Site, you may not; use the GPM Site in a manner which is unlawful or would serve to restrict or inhibit any other user from using or enjoying the GPM Site or the Internet; post or transmit any information or software which contains a virus, trojan horse, worm or other harmful or disruptive component; upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the GPM Site which is protected by copyright, or other intellectual property right, or derivative works with respect hereto, without obtaining permission of the copyright owner or rightholder.

Monitoring. GPM has no obligation to monitor the GPM Site. However, you agree that GPM has the right to monitor the GPM Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the GPM Site properly, or to protect itself or its visitors. GPM reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unlawful, unacceptable, undesirable, or in violation of this Agreement.

Limitation of Liability. GPM takes no responsibility for the accuracy or validity of any claims or statements contained in the web pages and related graphics on the GPM Site. Further, GPM makes no representations about the suitability of any of the information contained in GPM Site for any purpose. All such information is provided without warranty of any kind. In no event shall GPM be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use, performance or accuracy of information available from the GPM Site.

Recourse. If you are dissatisfied with the GPM Site or with any terms, conditions, rules, policies, guidelines, or practices of GPM in operating the GPM Site, your sole and exclusive remedy is to discontinue using the GPM Site.

Indemnity. You agree to defend, indemnify and hold GPM and its affiliate and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any Violation of this Agreement by you or users of the GPM Site, or in connection with the use of the GPM Site or the Internet.

Trademarks & Trade Name. Guardian Property Management LLC is a registered trade name with the Utah Department of Commerce, and a licensed real estate brokerage registered with the Utah Division of Real Estate. Any and all names, logos and icons identifying GPM products and services referenced herein are trademarks or registered trademarks of GPM. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.

Enforcement. This Agreement, including any and all documents referenced herein, constitute the entire agreement between GPM and you pertaining to the subject matter hereof. GPM’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any provisions of this Agreement are found to be void, invalid, unlawful or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. The provisions of this Agreement shall be governed by and construed in accordance with the laws of the State of Utah and the federal laws of the United States for its interpretation and enforcement.

Usage tracking. The GPM Site tracks user traffic patterns throughout, by gathering information about individual user’s domain names, browser types, referring domains and URLs, and the search strings users employ to find the GPM Site. This information is contained in every user's browser, and is used to enhance their experience in the GPM Site, to better prepare future content based on the interests of our users, or to modify the GPM Site to accommodate a variety of operating systems and browsers. By visiting the GPM Site, you agree to allow GPM to collect such anonymous information, in order to better serve our users’ needs, and improve the presentation of our web pages.

Cookies. A cookie is a small data file that certain Web sites write to your hard drive when you visit them. A cookie is simply a text file that can contain information such as a user ID or password that a site uses to track the pages you've visited. But the only personal information a cookie can contain is information you voluntarily supply yourself. A cookie can't read data off your hard disk or read cookie files created by other sites. Permitted Use of Site Information. The information contained in the GPM Site is protected by international copyright law. By visiting the GPM Site, you are granted a personal license to copy or print information concerning current vacancies being advertised for rent for your personal use only. None of the information in the GPM Site may be distributed for any commercial or non-profit purpose, including copying, downloading, posting on any public or private website, using or inserting in any database on a hard drive, CD-ROM, or other archival media like DVD-ROM, ZIP, floppy, in compressed or uncompressed archives, or distributing in printed media. Use of the information by any rental agency, real estate brokerage, or property management company or others who advertise rental property without prior written permission is prohibited, and will be considered in violation of the copyright.

Your privacy is very important to us. Licensed real estate professionals have been and continue to be bound by professional standards of conduct and confidentiality with respect to their clients, and others with whom they do business. As a professional real estate brokerage, we at Guardian Property Management LLC are committed to protecting the confidentiality of our clients’ personal and financial information.

Types of Information Collected at this Website.  No personal information is collected at this website. The only kind of information collected is general statistical data relating to how many guests have visited the GPM Site, and which subjects or web pages are visited most frequently. Because technology is constantly changing, by utilizing the GPM Site, you understand and accept any risks that could occur through electronic information sharing on the Internet. We make every effort to ensure our visitors the most private website visit available, but we cannot be held responsible for unforeseen or unintended access to visitor information.

If you elect to send us an e-mail requesting more information, (an option provided for in this website) your e-mail address and other information you provide will then be considered voluntarily released. This information will not be disclosed to any unrelated third parties, except as provided for in the paragraphs below.

Types of Non-public Personal Information We Collect.  During the course of our business, we may collect non-public personal information about our clients that are provided to us by our clients, or obtained by us with our clients’ authorization. This information usually deals with their rental property, its financing and operation, including, but not limited to, income, expenses, mortgages, ownership circumstances, and the physical characteristics of their rental property. We retain this information to better assist our clients with their needs in the efficient management of their respective properties, and in order to comply with professional guidelines and government regulations.

Protecting the Privacy of Current and Former Tenants.  In order to protect the privacy of both current and former tenants, we do not disclose any non-public personal information concerning our tenants, except as permitted by our current and former tenants in writing.  Examples include other landlords requesting a rental reference on a current or former tenant;  such information will not be released without an express written authorization by the tenant(s) in question.

Parties to Whom We Disclose Information.  In order to protect the privacy of both current and former clients, and website visitors, we do not disclose any non-public personal information obtained during the course of our business, except as permitted by our clients, website visitors, or as required by law. Permitted disclosures include, for example, providing prospective tenants with information regarding the physical characteristics of a rental property, and its rental terms. Other permitted disclosures include providing information to our employees, and in limited situations, to unrelated third parties who need certain information in order to assist us in providing services to our clients. In all such circumstances, we stress the confidential nature of the information being shared.

Protecting the Confidentiality and Security of Current and Former Clients’ Information.  We maintain physical, electronic, and procedural safeguards that prevent the unauthorized access, use, duplication or sharing of our clients’ non-public personal information.
